reports of spinouts. we'll have more on the commute plus take a look at mass transit. might be a good idea this morning. that's coming up. it is 5:00. a high school english teacher for having sex with one of her students. she spent the night in the solano county jail but this morning posted bail. anne makovec is in vallejo with the details. reporter: the 27-year-old teacher is free on bail this morning as police continue to investigate whether or not there were any other students involved. it is vallejo's case because she lives in vallejo but she was teaching over in fairfield. now, the teacher's name is felecia killings. again, 27 years old, an english teacher at rodriguez high school in fairfield. overnight she was at the solano county jail charged with

statutory rape for allegedly having sex with a 16-year-old male student who is now 17. sexual activity is alleged to have taken place at her home in vallejo. she has been a teacher at rodriguez high school for five years. officials for the fairfield suisun district tell us that killings was arrested on the school property there in fairfield yesterday evening. the school district is obviously aware of the issue. the school district are the ones who referred it to the police. she has been placed on leave while the investigation continues. and felecia killings is due in court again on november 30 at 8:30 a.m. for her arraignment. back to you. >> anne, thank you. anne makovec in vallejo this morning. and this morning, state senator leland yee is expected to announce that he is running for san francisco mayor. yee will be the first candidate to throw his hat into the ring. gavin newsom leaves office in

january to start his tenure as lieutenant governor. the board of supervisors will name an interim mayor until voters pick one next november. congressman jerry mcnerney appears closer to keeping his seat in california's 11th district. the pleasanton democrat now leads republican challenger david harmer by more than 2200 votes according to the latest vote tally by four counties. but election officials don't expect to certify their final counts for at least another two weeks. santa clara county will soon have more areas that are smoke-free. here's mark sayre to explain the new laws about lighting up and where they will take effect. good morning to you, mark. reporter: good morning. with the final passage of this last night by the santa clara county board of supervisors, the first phase of this new smoking ban will take place in 30 days. in the first phase this would ban smoking in parks, outdoor eating areas of restaurants and also at the santa clara county fairgrounds. the new ban will also ban smoking within 30 feet of any

outdoor service area such as a ticket line at a movie theater and within 30 feet of door ways that lead to indoor areas where smoking bans are already in effect. now, next year, the second phase of this ban goes into effect. that's going to ban smoking in all common areas of places where people live such as apartment complex, condominium or other communities where there are multiple units in one living area. so all that will take place next year, 14 months from now. believe it or not, at the board of supervisors meeting there was only one person who was a tobacco representative who spoke in favor of this smoking ban. it was approved yesterday, the first phase going into effect here in santa clara county in the unincorporated areas of santa clara county beginning 30 days from now, juliette. back to you. >> thank you, mark sayre in santa clara county. mark, thanks. it's an increase that some say threatens to price many families out of california colleges. the board of trustees will take a final vote today to increase

tuition by 15.5%. if approved, undergraduates would have to pay an extra $654 next fall. tuition would top $4,800 a year. students are expected to protest at the committee meeting in long beach today. meanwhile, the uc president is calling for an 8% increase in fees. president obama is in south korea this morning to attend a meeting of the world's top 20 economic powers. he arrived in seoul several hours ago for the g20 summit. south korea's the third stop on the president's four-nation economic and good will tour of asia. he visited indonesia yesterday, his home for four years when he was a child. that part of the trip, though, was cut short so air force one could avoid a cloud of ash caused by an erupting volcano. 5:05. let's check in with weather and traffic. and tracy is going to talk about our weather out there. >> good morning. yeah, we got some rainfall that moved in last evening.

and also extended throughout the forecast in the overnight hours. currently not a whole lot going on. most of the bay area pretty dry right now but we'll move in and show you some light showers moving into san francisco. some of them just off the coastline there but others just moving in down to the south of pacifica and also into san mateo. our forecast for today does include again just a little bit of rainfall for the morning but otherwise, we're expecting some sunshine. but take a look at the rainfall totals. .04" in napa, a little more than a tenth in santa rosa and also in san francisco as well as oakland. but definitely not the soak their we had sunday. so a little bit of sunshine expected later on today. today's high temperatures and also 70-degree temperatures, yeah, they are moving back into the forecast. i have the seven-day forecast coming up. elizabeth has a little traffic coming up, too. >> i do have a little traffic. we are getting several reports of spinouts that keep coming in on our chp reports. slick roads as well on highway 17 if you are coming through the santa cruz mountains. just got a new spinout on

southbound 880. when it spun out it may have been hit by a big rig so unfortunately we are not sure about lanes blocked in the area but chp is heading to the scene. our closest camera is right there by the coliseum where everything is flowing fine through here. but again, watch out for that accident southbound 880 on the approach to the 98th exit. several things happened on the eastshore freeway before 5:00 this morning. couple of spinouts, both on eastbound 80 so going against the commute but still causing a little bit of slow traffic. eastbound 80 approaching san pablo dam road we had an accident there still two right lanes are blocked. had another one on eastbound 80 approaching powell street in emeryville, as well. get your chains out. chains are required on all the roads heading up to the sierra on 80, 50 and 88. here's live look at interstate 80 at applegate. you will need chains between nyack and truckee. mass transit by the way is all running on time for bart, ace, muni and caltrain. we'll have much more on your morning commute coming up. back to you in the studio. >> thank you.

>> thanks, elizabeth. 5:10. welcome back, everyone. here's something you don't expect when you're out walking the dog, an attack by a pack of racoons. the latest attack happened in alameda sunday night in washington park. the victim says that one racoon went after her and her 20-pound border terrier and they are four more racoons dropped out of trees and joined in the chase. >> i fell down around that tree over there. i was on the ground. the dog is fighting off four out of the five racoons. one of them has like latched onto my leg, i'm screaming help me, help me, help me at the top of my lungs. >> you go get 'em! in the last five months nine small dogs and seven humans have been bitten in similar racoon attacks. they are attracted by food they find in uncovered garbage dumpsters. police in alameda hoping an adding dognapper will finally get his story straight. the 19-year-old was arrested on

suspicion of stealing a dog from that 80-year-old woman. he first told police that he sold the little yorkie to someone in the stockton area. but now he says he released or hm gave away the dog at holiday park in stockton. police are still looking for the dog, deuce, and a second suspect. a reward fund has been set up. 5:12 now. is it a mystery missile or just a jet? this morning, all indications are that the u.s. military was not involved. this is video, it was taken by our sister station in l.a. monday night. it looks like a missile with a vapor trail. but the pentagon says it didn't launch anything. norad says it wasn't a rocket from a foreign government. several defense analysts say it was actually an optical illusion. an airplane is actually flying toward the camera. the pentagon insist whatever the object was, it was not a threat to the united states. no air-conditioning and no working toilets. it's going to be a long slow

ride home for more than 3,000 people stranded on a carnival cruise ship off the coast of baja. this morning, the ship is actually limping back to port under tow. the cruise liner lost power when the engine room caught fire. no one was hurt. the passengers are getting by on canned crabmeat and spam. >> that's all they could find? >> i don't get this. flown in by u.s. navy helicopters. the ship is expected to arrive tomorrow night. i thought they would have tons of food. >> no working toilets. no internet service. out of cell phone -- these people actually have to talk to each other. >> what a concept. >> trade their stories of misery. 5:13 now. the final say on banning fast food toys in san francisco. >> must have relief for riders of a.c. transit. the last-minute deal that could avoid service cuts but it's coming at a price. >> we have a few leftover showers across the bay area

good morning. lots of spinouts, westbound 780, a new injury crash as you approach fifth. right now one lane is blocked. it continues to be slow in those westbound lanes of 780. this one we have been dealing with about just before 5:00 this morning. it is going against the commute eastbound 80 right there as you approached san pablo dam road. another injury crash, a car went into a ditch. it is going against the commute so it's not super slow but chp and tow crews are heading to the scene. two right lanes are blocked only in the eastbound direction. westbound traffic 65 miles per hour. so it looks good all the way into berkeley. 880 through oakland, southbound 880 in fact, approaching 98th. this is another spinout where a car may have hit a big rig. it sounds like at least one lane is blocked there. again not seeing any slowing on our sensors because it is still early. we can show you a live look near the coliseum. a little farther north of that accident where traffic is flowing fine in all directions and looks good up into downtown

view, not a lot going on otherwise other than the few showers that we have just pushing into parts of the peninsula. so the forecast for this morning, what can you expect? a few showers still out there. mostly cloudy conditions. temperatures for the morning in the mid-40s to the mid-50s. moving into the afternoon, bye- bye rainfall, hello sunshine! mostly sunny conditions expected. cool and breezy for the bay as well as for the coast. how breezy? northwest winds up to 20 miles an hour. so even though today's temperatures are pretty much on par with yesterday's highs, it's going to feel cooler once you factor in the winds. highs upper 50s at the coast, lower 60s at the bay and the mid-60s inland. here's a look at what's happening. a cold front came through. you can see the snowfall that moved through the sierra currently. we showed you that nice video. and now you can see something else, back behind us, not a lot of activity. that's why we're expecting things to clear out nicely just in time for the afternoon. today's highs, 60 in san francisco, i know, that's not so hot. lower 60s in vallejo, oakland, also in fremont. and the lower 60s in

will run for san francisco mayor. and next month more parts of santa clara county will be smoke free. the board has given final approve to a smoking ban for new parks and outdoor eating areas of restaurants but starting in 2012 the ban will also apply to apartments, condos and townhouses. good news for thousands who take mass transit. a.c. transit won't cut service again next month as planned because it reached a contract deal with more than 1700 drivers and mechanics. the three-year deal means paycuts, new work rules, one less holiday and a $10 co- payment for medical appointments. it's expected to cut the a.c. transit's deficit by $38 million over the next three years. and it is official. toys will be banned from some fast food kids meals in san francisco. the city board of supervisors

arrested last evening accused of having sex with one of her students. she is out on bail right now, a $50,000 bond. she is due in court later on this month. now, her name is felecia killings. she is a high school english teacher, 27 years old. she teaches at rodriguez high school in fairfield. the male student was 16 years old at the time. he is now 17. the reason vallejo police are investigating is because the sexual activities are alleged to have taken place here at killings' home in vallejo. she has been a teacher at recognize high for five years. now, the fairfield suisun school district tells us that killings was arrested on the school property last evening and the school district had actually referred it to the police. that is when they came and made the arrest. she has been placed on leave while the investigation continues. and she is scheduled to be arraigned on november 30th at 8:30 a.m. in the meantime police are investigating whether or not other students may also have

been involved. >> all right, anne makovec. thank you. conflicting accounts this morning of whether oakland police were justified in shooting a domestic violence suspect. police say 37-year-old derek jones was choking a woman and slamming her head at a laundromat on bancroft avenue on monday night. he took off when cops came. they first tried to tase him but opened fire when he reached for something in his waistband. the family questions his account. police say jones had a metal object on him but wouldn't say what it was. the race is on to become san francisco's next mayor. state senator leland yee is expected to announce his candidacy at a news conference this morning. gavin newsom leaves office in january to start his tenure as lieutenant governor. the board of supervisors will name an interim mayor until voters pick one next november. congressman jerry mcnerney appears closer to keeping his

seat in california's 11th district. the pleasanton democrat now leads republican challenger david harmer by more than 2200 votes. that's according to the latest vote count by the four counties involved but election official don't expect to certify the final count for at least another two weeks. the top vote-getters in the oakland mayoral race also spent the most on their campaigns. according to the "san francisco chronicle," don perata was the biggest spender with his final total expected to clear $800,000. he is followed by city council members jean quan and rebecca kaplan. quan currently holds a slim lead over perata in the new ranked voting system. final results could be later this week. santa clara county will soon have more areas declared smoke-free. here's mark sayre to explain the new laws and where they will take effect. good morning to you, mark. reporter: juliette, good morning. this is actually making santa clara county one of the most restrictive smoking bans in the

entire nation. now that it's been approved by the board of supervisors, the first phase of this ban goes into effect in 30 days. that first phase of the ban will ban smoking in all public parks, any outdoor eating areas of restaurants, and also at the santa clara county fairgrounds. it will also prohibit smoking within 30 feet of any outdoor service area such as a ticket line and within 30 feet of any kind of doorway that leads to an indoor area where existing smoking bans are in effect. >> i think that's good because i have asthma so i know like when people smoke and everything, it affects my lungs and everything and i have a lot of people in my family who smoke, too, so it's not good so i'm glad they banned it. >> make people live longer, man, safe a little money. a lot of money. >> reporter: ry smoker? >> yes. >> reporter: this makes it harder for you to smoke? >> maybe it makes it easier for me to quit. >> reporter: the second phase of the ban goes into effect in

2012. that's going to prohibit smoking in indoor apartments, condominiums or multi-family complexes. if you live in an apartment that's in unincorporated santa clara county only where these bans take effect, you cannot smoke inside your own apartment beginning in 2012. during the debate on this smoking ban, the estimate was this affects about 300 multi- family units in unincorporated santa clara county. back to you. >> thank you, mark sayre in santa clara county. several pot clubs in san jose have closed citing a series of police raids on their operations. yesterday, medical pot activists asked the city council to stop those raids but had mayor chuck reed said city leaders have no authority because the raids were conducted by a santa clara county special enforcement team. the team's mannedder told the "mercury news" said they were targeting clubs that sold pot for profit in violation of state rules according to the team's commander. the pg&e executive who

day three years from tomorrow. 5:36. let's go back to tracy and elizabeth to find out what's happening with weather and traffic. does one affect the other? >> for the morning it might. we have slip very roads because we still have a few light showers out there. when say few, i mean just a few. pushing towards pacifica and south of half moon bay. other than that the rainfall that we had in the overnight hours has essentially moved out of the bay area. rainfall totals, not really that much. a little more than .10" in santa rosa, tenth of an inch in san francisco. .14" in oakland, otherwise a few hundredths of an inch across the rest of the bay area. today rainfall early, after that plenty of sunshine. today's highs and your seven- day forecast: 70-degree temperatures moving back into the forecast. more on that coming up. here's elizabeth. >> it's going to take a while

for the roads to dry out. chp says it's still a problem on the westroads and they need drivers to slow down on highway 17 because of wet roads. warning signs activated on highway 17 near the summit so take it slow up towards los gatos. still top speeds around the south bay coming up from morgan hill northbound 101 great. 71 miles per hour as you head into san jose. and here's 280. no problems. several spinouts earlier this morning. a lot of things are being cleared quickly. this one was southbound 880 approaching 98th. the tow truck came and went. they already changed it to a question mark meaning it's gone. closer to the coliseum, north- and southbound traffic fine all the way up into downtown oakland. this accident has been cleared as well, westbound 780 in benicia approaching fifth. a little slowing on our sensor through that stretch of

volcano, mount merapi. that volcano has killed more than 190 people. iraq's christian community is falling under increased attacks the latest in baghdad. five people were killed in a series of coordinated bombings in catholic neighborhoods. two weeks ago, a christian church came under assault in a mass killing that took 56 lives. al qaeda claimed responsibility. it's estimated that a million christians have left iraq since 2003. singapore airlines is the latest to ground some of its jumbo jets. the airline has taken its free airbus a-380 jumbo jets out of service to deal with oil stains. the same problem grounded qantas airlines jets last week after an engine exploded midflight forcing an emergency landing. the engines will be replaced. other types of jets are still in service. america's most famous airline pilot is sounding the

and slowdowns on highway 17 near the summit. now a car spun out so one lane is blocked on northbound 17 through the santa cruz mountains towards los gatos. so chp is heading to the scene. slow down. the roads are wet. here's a live look outside. at the bay bridge toll plaza, so far no delays as you approach the pay gates, no sign of metering lights. they probably won't be on for another half hour or so. so no delay right now. looking good heading into san francisco. we saw a couple of earlier spinouts along the eastshore freeway right before 5:00 this morning. live look at the san mateo bridge. the right side of your screen is the commute direction. nice and light 13 minutes towards the peninsula if you are commuting from hayward. we are starting to see slowing on our sensors through antioch,

francisco mayor. it will make him the first major name to throw his hat into the ring. mayor gavin newsom starts his new role as lieutenant governor in january. santa clara county will have a new set of antismoking laws in unincorporated areas beginning next month. the laws will ban smoking in parks, the fairgrounds and outdoor eating areas of restaurants. starting in 2012, it will also include apartment condominium and townhouse units. flu season has arrived and contra costa county is already working to fight the virus. today the county is hosting free flu shot clinics at 9 different locations. residents can just walk in and get the vaccinations. the flu vaccine protects against three flu viruses including h1n1. one clinic will be held at the richmond auditorium. all of the sites will be open from 1 p.m. to 7 p.m. for other clinic locations, you can call the number on your

morning. here's elizabeth with a check of our traffic. >> a crash in vallejo involves another car spinning out of control. westbound 37 before the fairgrounds a pickup truck into the wall facing the wrong direction. we have seen a lot of spinouts this morning. nothing causing huge delays but a lot of these accidents can be avoided by slowing down. highway 17 the warning signings are still activated warning of wet roads, slick conditions and asking drivers to slow down in the area. in fact, we had an accident just pop up northbound 17 at the summit which is still not cleared blocking one lane. as you head up through the santa cruz mountains. we can show you a live look outside. this is the view from milpitas, 880/237. this is traffic on westbound 237. commute to silicon valley. so far traffic is fine as you head towards mountain view. and a good-looking drive time there, as well. 6 minutes from 880 out towards 101. that's your traffic. here's tracy with your forecast. hey, thanks, elizabeth.
